The tree was already mostly dead. I believe when the previous homeowners had the drive paved the poor fellows roots were cut. He may spring back though as I didn't "girdle" the tree, so there is a possibility
that he may sprout a crown come next spring.

To girdle a tree one must cut the bark through the cambium layer all the way around the trunk. Since the trunk has cotninuous bark from base to top on roughly 60% of it's surface it may still sprout. It can still transfer nutrients.
