Well, your link isn't working for me, but my brother owns his own business and went through this a little while ago. A company opened up with the same name.
(disclaimer that I have NO idea how the internet works, or if it has different rules, this is for brick and morter stores)
Essentially, the dispute went to who had registered the name first. (in this case, not my brother).
So, I'm not sure who or where you need to register your business name (and logo, if it's important to you), but that would be the first step in any legal action. Check with the local authorities for how/where to register.

If the name Rock Bottom Cemetary is legally yours (and by that I mean you have a d/b/a with the secretary of state's office) then you can ask him to stop using it. I would make it a formal letter. Give him a period of time to cooperate and let him know (diplomatically) that if he doesn't stop further legal action will be taken. Then I would contact your secretary of state's office and find out the procedures for your state on filing a complaint against the offender. Before you tell him to stop using though you need to make sure your d/b/a is still active. You can do that online at your state's secretary of states site.

UO I didn't know why the link doesn't work for you it works for me,?
The way I found out was I did a google search this am for rockbottomcemetery and it showed in the google search

The link didn't work for me - so i copied and pasted it in word and chased it down... If I linked to the right site (looks like a yahoo forum or something), it appears that RBC is simply the title of the page with a link to your site - if you go to view pervious or next post, there are links to other websites as well...perhaps they are just doing some advertising for you?

RBC... I don't know exactly what your link is going to, other than the coffin talk forum. I did see a thread in the "Links" section of that forum called Rock Bottom Cemetery posted by Victorian Lady. This just seems to be a link to your website.... not claiming it as their own.

Don't know why someone in their right mind would use your company name to steer business their way.
Maybe they know how cool you are and want a little of that coolness for themselves.

I just noticed when I ran a search on the website for the registered owner, it is showing you are.
How would you be able to get them bumped from using you're site name? Can you charge them rent for using your domain that you paid for?

Thanks you made me feel so much better. I have know idea WHY they would do that I got the name from the street I live on > Brant Rock Dr so I thought it would be cool to name it Rock Bottom Cemetery since you can't get any lower then that,lol
oh , I have my lawyers looking in to this Now, They didn't like it one bit..
