I understand that it's the principle of the thing, but honestly the cost of hiring a lawyer (even just to write a letter, not to mention any other fees associated with litigation) could well exceed the value of the deal ($85) you were supposed to get on Dr. Shivers. *shrug*

Sorry for what happen to you. As a Criminal Justice major and a former Police Officer all I can tell you is unfortunately you have no case. There is no proof you paid for Dr. Shivers even though you did. If you had a receipt that stated the items that you bought then you have something.But in this case you don't.It really just boils down to your word against hers. if you had someone with you as a witness that might have helped. I'm sorry for your loss Don't leave any kind of threatening messages on her answering machine because she can and will most likely turn it around on you saying your a stalker blah blah harassing her blah blah I have seen it go down this way many a time. I would def report her to Craigs list as fraud that I think is all you can really do. Maybe it will scare her! Good luck!

THE CONCLUSION. Well its over and heres how it went down. I know I couldnt go back to the house without a witness, because the owners of the house could say I threatened them. So I did what one of you suggested....I BROUGHT THE POLICE. Its called a "conservator" I believe. They come and keep the peace.
Basically I told them my story, we went over to the house. The police did all the talking. The woman who screwed me over doesnt live there. So when the people answered the door, the police told them the story. They said that I stole items from her...blah, blah, and they have a witness. I figured two things. One they would say I didnt pay the full $305.00, or two, that I stole something that wasnt on the pile of stuff. When the woman and I were loading up my car she took an item back saying that wasnt on the pile, that should have been my red flag. I made a pile of stuff, covered it and LEFT to another yard sale, everything on that pile was mine..anyways. The police said with yard sales to ALWAYS make a contract when you're leaving stuff and it would be 50/50 in court. They said I'm a young guy and to just chalk it up as a loss. The officers were very nice.
So yard salers, learn from my heartbreak. If you buy lots of stuff, take it in one trip, or GET A CONTRACT. I also consulted a lawyer and he said I would prob win, but collecting the money could take 10 years. So, I'm letting this go, hoping the police will give the woman a little scare.
It could have been worse....what if I left everything there and tried to come back the next day? I would be out $150.00. Basically you need witnesses and contracts. ..handshakes dont get it done anymore.
Dont feel bad for me though, I got alot of good stuff.

Wow, what a horrible ordeal. I have bought things from Craig List and garage sales and am always worried about problems. I drove abot 85 miles once to pick up a patio bar. The guy was gone when I got there. It was summer and hot and he was an air conditioner guy. I talked to him on the phone and he told me to go on into his backyard and pick it up and leave the cash under a pot on the deck. Uhhhhh NO!
I waited on him for 2 hours. He was very nice and helped load it and tie it down. But, did he think I was a fool. I had no way of even knowing for sure that the ad was his and it was his address he gave me. I would have been SOL.
Sorry for your loss but glad that it didn't get worse.

I wouldn't be surprised if some of the stuff she sold you was stolen, or sold and resold. There's a lot of thieves out there.
